Unbounce AI Hybrid Builder Terms

1. These terms. These AI Hybrid Builder Terms (the “AI Terms”) supplement the Unbounce Terms of Service at https://unbounce.com/terms-of-service/ (the “Terms”) and apply to your use of AI Features and AI Credits in the Unbounce AI Hybrid Builder. Capitalised terms not defined here have the meanings given in the Terms. If these AI Terms conflict with the Terms, these AI Terms govern for AI Features and AI Credits. By signing up for an Account that includes AI Features, or by using AI Features, you agree to these AI Terms and to the Terms.

2. Definitions. AI Features: Features of the Services that generate, edit or suggest Content using artificial intelligence, including Unbounce AI in the Unbounce AI Hybrid Builder.

AI Credits: The units by which use of AI Features is measured and charged, as described in these AI Terms and on the Unbounce pricing page or in your Account.

3. AI-generated content. Content generated by AI Features may be inaccurate, incomplete, misleading, or not reflective of recent events. You are responsible for reviewing AI-generated content before publishing it, and for confirming the accuracy of any factual claims it contains. Unbounce does not warrant the accuracy, completeness or fitness for purpose of AI-generated output.

4. Permitted use of AI Features. AI Features are intended for the creation of marketing landing pages. They are not intended for, and must not be used for, recruitment or candidate screening, assessment of creditworthiness, insurance pricing or underwriting, determining access to essential public or private services or benefits, or any use requiring a Business Associate Agreement. Unbounce does not represent that AI Features are suitable for any such use. Your use of AI Features is also subject to the acceptable use policies of the AI providers whose models Unbounce uses, and Unbounce may decline to generate content that does not comply with these AI Terms or those policies.

5. Your disclosure obligations. Where applicable law requires you to disclose to your visitors that content was generated or assisted by AI, meeting that requirement is your responsibility. Unbounce does not provide visitor-facing disclosure on your behalf. AI-generated text produced by Unbounce AI is marked in a machine-readable format.

6. Ownership of AI-generated content. As between you and Unbounce, Content generated by AI Features at your request is treated as your Content under Section 9 of the Terms, subject to the rights of third parties. Similar or identical output may be generated for other users. You are responsible for ensuring that your prompts and your use of AI-generated content do not infringe the rights of others, including trademarks and other intellectual property, and Unbounce makes no representation that AI-generated content is original or non-infringing.

7. AI Credits. Where your plan includes AI Credits: (a) your Account receives the monthly allowance of AI Credits stated for your plan on the Unbounce pricing page or in your Account. The allowance resets on each billing date and unused allowance does not carry over; (b) where available, you may purchase additional AI Credits (top-ups) at the price shown at the time of purchase. Top-ups are used only after the monthly allowance for the current billing period is exhausted, are non-refundable, and expire 12 months after purchase or when your subscription is cancelled, whichever is earlier; (c) Trial Accounts receive the trial allowance stated on the Unbounce pricing page or in your Account and cannot purchase top-ups; (d) AI Credits have no cash value and are not transferable between Accounts. The AI Credits consumed by an action are as stated on the Unbounce pricing page or in your Account; (e) on an upgrade, the new allowance applies from the date of the upgrade. On a downgrade, the new allowance applies from the next renewal. AI Credits already used are not refunded or reclaimed; (f) Unbounce may change allowances, prices and consumption rates in accordance with Section 4.5 of the Terms.

8. Updates. Unbounce may update these AI Terms as the Terms allow, and may incorporate them into the Terms of Service. The version posted at the time of your use applies.
